New Delhi: The Supreme Court on Monday refused to entertain a fresh petition filed by some examinees challenging the government’s decision to cancel the UGC-NET exam following an alleged leak of question papers, saying accepting it at this stage will create “chaos”.
A bench comprising Chief Justice DY Chandrachud and Justices JB Pardiwala and Manoj Misra said the government will conduct the exam again on August 21 and the students, who are around nine lakh, must be given some sort of “certainty now”.
“The intervention of the Supreme Court now will have a serious effect and there will be chaos everywhere,” the CJI said while refusing to entertain the petition filed by Praveen Dabas and others.
The court said the exam was held on June 18 and was cancelled a day later.
“Accepting the petition at the present stage would only add to the uncertainty and utter chaos,” the CJI said, adding that the central government must be “doubly cautious after the NEET-UG fiasco and that is why it was cancelled. Let this process continue now.”
The top court had earlier dismissed a PIL on the issue, saying it was filed by a lawyer and not by affected candidates.
“Why are you coming? Let the students come here on their own,” the Chief Justice had told the lawyer, adding that “while we reject the aforesaid PIL, we are silent on the merits.”
The court had asked advocate Ujjawal Gaur, who filed the PIL as a petitioner, to focus on some legal issues and leave those matters to the affected people.
The above petition was also filed against the decision of the Union Education Ministry and the National Testing Agency to cancel the UGC-NET examination after receiving information that its integrity could have been compromised.
On June 19, the Ministry ordered the cancellation of the UGC-NET exam and handed over the matter to the CBI for investigation.
